Driver's License Restoration

Michigan Driver’s License Restoration

Czarnecki Taylor has a greater than 95% winning record as driver’s license restoration attorneys.

In the State of Michigan, public transportation is severely lacking. A driver's license is critical to an individual's well-being and ability to make a living.  Without a license, you cannot work and earn an income.  You cannot take children to and from school, make doctor's appointments, and visit family.  Essentially, you must rely on others to drive you where you need to be.  That process can be burdensome for all those involved. If your driver's license has been revoked because of drinking and driving offenses, Czarnecki & Taylor can help.  The driver’s license appeal process is the first step in getting your life back under your control.  You will no longer have to rely on others for transportation.

One misconception we often hear from clients is that the OHAO will deny you the first time you appear.  That is not true, at least not in our experience.   However, this often happens when people do not hire an attorney or, even worse, hire the wrong one. That is why it is essential to hire an experienced Michigan driver’s license appeal attorney. At Czarnecki & Taylor, we want to win at the first hearing. Our methods have resulted in a greater than 95% success rate. Our success is related to our approach: we prepare our clients better than other attorneys.  We have written several articles for you explaining the driver’s license restoration process:

We tell our clients that we want to win their case before we appear for the actual hearing. What does that mean? The evidence presented to the Michigan Secretary of State must be carefully reviewed and prepared. Simple mistakes such as unclear sobriety dates, incomplete substance abuse evaluation reports, and inadequate reference letters, among other errors, can cost you a win. The proper presentation of evidence is a complex matter. Many people, including attorneys, must be more precise when reviewing the evidence. We know this because many people have contacted our firm to represent them after they either represented themselves or had an attorney that did not been precise.

The proper organization and preparation of evidence can be overwhelming. When we handle a Michigan Driver’s License Appeal, we review all of the material before we submit the request for a hearing. Our office will organize the evidence for you, and we will submit it to the SOS only when it is perfect. We will review the testimonial letters for appropriate evidentiary content. We will direct you to substance abuse evaluators that the SOS hearing officers respect. We will cross-check your evidence to make sure the evidence is consistent. We will prepare you to testify. We know what the hearing officers are going to ask you. We will help you answer the question in a way that erases any doubt that you are deserving of your driver’s license restoration.

Again, before we file your paperwork to request a Michigan driver’s license restoration hearing, we diligently and thoroughly review all of your documents.  This means we review the substance abuse evaluation report, the 12-panel drug screen, the letters of reference, and AA attendance sheets, among other evidence. We ensure that the evidence is consistent and reliable to survive under the strict scrutiny of the hearing officers.  Our winning record is the direct result of extensive preparation.  Once the documents have been submitted, and our office receives a notice of hearing from the OHAO, we will arrange a time to prepare you to testify. We will ask you all of the questions that will be asked during the hearing.  We find that a prepared client is a relaxed client, and that helps make a favorable impression on the hearing officer.  We have appeared at nearly every OHAO hearing officer in Southeastern Michigan, so we have the experience and understanding of what each hearing officer requires. By “clear and confining evidence,” we persuasively show that you can drive according to the law. It is your burden to prove you should drive again, and we do everything to overcome that burden with you.  We work together. If you have moved from Michigan and live in another state, we can help you obtain a "clearance" so your new home state can grant you a driver's license.  We have represented people from Florida, Texas, New York, Ohio, and several other states.

Many people who have lost their Michigan driving privileges believe their circumstances are so dire that they choose to delay a Michigan Driver’s License Appeal at the Secretary of State. This could not be further from the truth. No situation is too bad. With the correct preparation, even the most severe cases can and will be won. Through decades of handling Michigan Driver’s License Appeals, we have seen every situation that involved the loss of a driver’s license. We have seen cases ranging from OWI causing death, civil infractions causing death, numerous drinking and driving convictions, medical denials, and many others. When you speak with our office, we will explain we have seen people in your situation before and probably worse.

We'll be able to meet with you during a free consultation to go over your case and explain the hurdles that need to be overcome.
